1.1. “Apex Aesthetic” is a sole trader registered in Scotland.

1.2. Apex Aesthetic provide beauty services (known as “treatments”).

1.3. www.apexaesthetic.co.uk is a website Apex Aesthetic have provided for information purposes only. All treatments are booked, managed and fulfilled by Apex Aesthetic.

1.4. Apex Aesthetic services are bookable online via the Apex Aesthetic website (www.apexaesthetic.co.uk) and are handled via Ovatu (www.ovatu.com), a third party booking system.

1.5. By using this Website and/or purchasing treatments you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, please do not use or access this Website. You must read and accept all of the terms and conditions before you may use or access the Website in any way.

2. Website Terms of Use

2.1.You agree to the following;

2.1.1. That you are 18 years of age or older and are legally capable of entering into a contract.

2.1.2. That you understand, acknowledge and accept the terms and condition outlined in this contract.

2.2.The content of the pages of this website is for your general information and use only. It is subject to change without notice.

2.3.This website uses cookies to monitor browsing preferences.

2.4.Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

3. Booking Policy

​

3.1. All treatments booked with Apex Aesthetic are handled via Ovatu (www.ovatu.com), a third party booking system who’s Terms & Conditions Apex Aesthetic take no responsibility for and accept no liability for. No Terms and Conditions upheld by Ovatu will supersede the Terms & Conditions contractually agreed when booking treatments with Apex Aesthetic.

3.2. Apex Aesthetic require a 50% deposit of the total cost of booked treatments.

3.3. Apex Aesthetic reserve the right to cancel or amend your treatment at any time. 

3.4. Apex Aesthetic have no obligation to accept a booking made for treatment(s). Booking Confirmation emails received when booking treatment(s) are automated and can be superseded by express cancelation or denial in writing from Apex Aesthetic.

3.5. A deposit being processed and funds deducted from a customer’s account do not constitute a confirmation of booking and will be refunded by Apex Aesthetic in the event that a booking is cancelled or denied.

3.6. When booking a treatment, the customer is required to follow a booking process. This includes providing personal information required by Apex Aesthetic. The customer is responsible for ensuring the information they provide is correct, current and accurate. A failure to do so may result in a treatment being refused.

3.7. Apex Aesthetic may hold a customers card details on file to assist in the booking process and reserve the right to process the balance of a treatment using these details.

3.8. Contacting Apex Aesthetic via (and not limited to) email, phone or message is for information purposes only and does not constitute a booking. All bookings must be made via the Apex Aesthetic website and Ovatu and secured with a 50% deposit.

 

 

4. Terms of Service

4.1.The customer agrees;

4.1.1. To complete a pre-treatment consultation form fully and accurately prior to their treatment commencing.

4.1.2. To update an existing pre-treatment consultation form held on file by Apex Aesthetic prior to a treatment commencing.

4.1.3. To engage in a pre-treatment telephone/video call consultation to assess their suitability for a treatment prior to a treatment commencing.

4.1.4.To complete a patch test when required at least 24 hours prior to a treatment commencing.

4.2. Apex Aesthetic reserves the right to cancel or amend a customers booking at the pre-treatment consultation stage if any information provided by the customer poses concern to Apex Aesthetic for their suitability to a treatment.

4.3. Apex Aesthetic only operate services within the stated postcodes (G1, G2, G3, G4, G5, G6, G7, G8, G9, G10, G11, G12, G13, G14, G15, G16, G17, G18, G19, G20, G21G22, G23, G24, G25, G26, G27, G28, G29, G30, G31, G32, G33, G34, G35, G36, G37, G38, G39, G40, G41, G42, G43, G44, G45, G46, G47, G48, G49, G50, G51, G52, G53, G54, G55, G56, G57, G58, G59, G60, G61, G62, G64, G65, G66, G67, G68, G69, G70, G71, G72, G73, G74, G75, G76, G77, G78, G79, G80, G81, ML1, ML2, ML3, ML4, ML5, ML6, PA1, PA2, PA3, PA4, PA5, PA8). Apex Aesthetic will only provide services out-with these postcodes with express written agreement prior to booking. Without express written agreement, a treatment may be cancelled by Apex Aesthetic in accordance with the clauses set out in section 3. 

4.4.The customer is obligated to:

4.4.1. Provide a clean, tidy, private and appropriate space in their home for a treatment to be carried out.

4.4.2. Be present at the arranged address at the time of the appointment to allow access for Apex Aesthetic to set up and carry out the treatment(s).

4.4.3. Behave appropriately during the treatment.

4.4.4. Adhere to and follow the aftercare guidelines as supplied by Apex Aesthetic.

4.4.5. Report any unexpected or lasting side-effects following the treatment to Apex Aesthetic.

4.4.6. Provide the necessary and accurate information for booking including name, address, email address, landline and mobile telephone numbers.

4.4.7. Provide a satisfactory level of cooperation during the treatment to allow the treatment to be carried out.

4.5. Apex Aesthetic undertakes to use reasonable skill and care in providing the treatment(s) as described.

4.6. Apex Aesthetic makes no warranties as to the outcomes of the treatment(s). Treatment(s) are provided on the basis that the customer is responsible for engaging with the treatment(s).

4.7. The customer is responsible for choosing the treatment(s).

5. Cancelation Policy

​

5.1.Cancellation by the Customer

5.1.1. Apex Aesthetic enforce a strict cancellation policy. Cancellations made at least 24 hours prior to the agreed appointment time will incur no fee. Cancelations made less than 24 hours prior to the appointment time will be charged at 50% of the total cost of booked treatment(s) or 100% of the deposit paid for the treatment(s), whichever of which is of greater value.

5.1.2. Customers who fail to be at the arranged address at the time of the appointment will be treated as a cancellation and will be charged at 50% of the total cost of booked treatment(s) or 100% of the deposit paid for the treatment(s), whichever of which is of greater value.

5.2.Cancelation by Apex Aesthetic

5.2.1. Apex Aesthetic shall be entitled to cancel or suspend services in accordance with any breech of any part of this contract.

5.2.2. Apex Aesthetic reserves the right to deny provision of service in the future where a customer has breeched any part of this contract.

5.2.3. Apex Aesthetic will not tolerate customers being rude or offensive or otherwise abusing the treatment(s) in any way and reserves the right to terminate the Service with immediate effect as a result of such behaviour (at Apex Aesthetic’s discretion). In this instance, the customer will be charged at 100% of the price of the booked treatments, regardless of whether the treatment has been completed or not.

5.2.4. In the rare circumstances that Apex Aesthetic is unable to fulfil the customers appointment, whenever possible Apex Aesthetic will contact the customer by telephone.

 

6. Service Charges

6.1. Apex Aesthetic accept payment in British pounds sterling only.

6.2. The customer confirms that the credit/debit card that is being used is theirs. If the customer’s card issuer refuses to authorise payment, Apex Aesthetic will not accept your deposit and we will not be liable for any delay or non-delivery and are not obliged to inform the customer of the reason for the refusal. Apex Aesthetic are not responsible for your card issuer or bank charging the customer as a result of our processing of your credit/debit card payment in accordance with the Order Confirmation.

6.3. The customer shall not be entitled by reason of any set-off, counter-claim, abatement, or other deduction to withhold payment of any amount due to Apex Aesthetic.

6.4. The customer is responsible for paying for any charges associated with using their debit or credit card.

 

7. Disclaimer and Limitation of Liability

7.1.The customer uses treatment(s) provided by Apex Aesthetic at their own risk and in no event shall Apex Aesthetic be liable for any direct, consequential, incidental or special damage or loss of any kind (except personal injury or death resulting from Apex Aesthetic’s negligence) including, but not limited to, inability to use social media, loss of money, the User’s identity theft, data breach, loss of or corruption of data or the User’s inability to use the Service, however caused and whether arising under contract or tort, including negligence or otherwise except as expressly provided herein.

7.2.If any exclusion, disclaimer or other provision contained in this Agreement is held to be invalid for any reason by a court of competent jurisdiction and Peaches becomes liable thereby for loss or damage that may lawfully be limited, such liability whether in contract, tort (including negligence but specifically excluding personal injury or death resulting from Peaches ’s negligence) or otherwise, will not exceed the value of Service (price paid for the Service) immediately preceding such liability arising.

7.3.The website user must make every effort to secure their username, passwords details and should not under any circumstance disclose their username and password and details to a third party or by an email request. Apex Aesthetic will not be liable for damages arising out of or in connection with the use of this website. This is a comprehensive limitation of liability that applies to all damages of any kind.

7.4.It is the website user’s responsibility to maintain and update browser, firewall or anti-virus and anti-spyware software. The User must protect their computer and/or device and ensure they update all security software by downloading the latest security patches from relevant software provider.

7.5.The customer must take full responsibility for the decisions involved when choosing an undergoing treatment(s) and understands and accepts that any decision made is entirely at their own risk.

7.6.The customer agrees to disclose any information with regards to any type of allergies or sensitives or issues or conditions suffered by the customer and the information must be communicated in writing to Apex Aesthetic in advance of the service commencing.

7.7.In the event the customer has not made the necessary disclosure in writing to Apex Aesthetic in accordance with section 3 and section 4 and under clause 7.6, Apex Aesthetic will have no responsibility for any adverse reaction suffered by the customer when using the service or any health issue suffered during or after the delivery of the treatment(s).
